Thank you for visiting our website www.populix.co, (“Website”). Please read these Terms of Use (“Terms & Conditions”). These Terms do not only govern Your use of Website, but also Your use of other services offered by PT POPULIX INFORMASI TEKNOLOGI (“Populix”), which are; Poplite, as available in researcher.populix.co (“Poplite”), and Populix mobile application that is available on Apple AppStore and Google PlayStore (“Populix App”). User is advised to read this Terms and Conditions because it may affect their rights and obligations under the law You or User shall mean the following: a. Any person who opens and/or accesses Website; b. Any person or business entity, either in the form of legal entity or not, who utilizes self-service market research, Poplite; c. Any person or business entity, either in the form of legal entity or not, who utilizes customized research service by Populix; and/or d. Any person who uses and/or signs in to Populix App, and/or participates in survey or study that is available in Populix App.

User Statement
1. By ticking “I understand” on the registration page, signing up and/or using the Websites, or participating in a Populix study, the User is deemed to have read, understood, and agreed to all contents in the Populix Terms & Conditions.
2. Terms & Conditions constitute a valid agreement between the User and Populix. If the User does not agree to one, part, or all of the contents of the Terms & Conditions, then the User is not allowed to use the services on the Populix Websites.
3. Populix reserves the right, at any time and from time to time, to change and/or replace these Terms & Conditions in whole or in part, without prior notice to the User. The User who continues to use Populix services is considered a sign of affirmative acknowledgment of any modifications and a sign of the User’s agreement to remain bound by the amended and/or replaced Terms and Conditions. The User is expected to check this page from time to time for changes that Populix has made, as they are binding on the User.
4. Populix processes information about Users per our Privacy and Cookie Policy https://info.populix.co/articles/kebijakan-privasi By using the Populix service, the User agrees to such processing, and the User guarantees that all data provided by the User is accurate.
5. Access to Populix services is provided “”as is””, and the use of Populix services is at the User’s own risk. To the extent permitted by law:
  - Populix expressly excludes all terms, warranties, and other conditions which may not be statutory, not in accordance with the common law, or otherwise
  - Populix expressly excludes liability for indirect or consequential loss or damage incurred by the User in connection with Populix services or with the use, inability to use, or results of using Populix services, whatever the cause
  - Unless the User has entered into a contract with the company for the provision of services, Populix expressly excludes liability for direct loss or damage that the User suffers in connection with the Populix services or with the use, inability to use, or results of the use of Populix services, whatever the cause
  - If the User has entered into a contract with Populix for the provision of services per the Populix Terms of Service below, Populix’s liability to the User in connection with such services shall be subject to such limitations and exclusions as may be stated in the Terms of Service.
Participation
1. In order to use the service and/or become a Populix participant, the User is required to register at the Populix application and complete the account registration process as prepared by Populix.
2. Account and password confidentiality and activities of an account are the personal responsibility of the owner of the account. Populix is not responsible for any activities carried out by an account, except for those carried out by Populix and directly impact the account owner.
3. Email and mobile number may only be used 1 (one) time for the Populix account registration process.
4. User is only allowed to use 1 (one) account in the Populix service, even though the User uses a different email and/or mobile number in the account registration process. If it is found that more than 1 (one) account has been created by 1 (one) User, Populix has the right to terminate the User’s account.
5. User who wishes to use Populix’s services must provide Populix with correct, accurate, up-to-date, and complete personal data information. If the User does not provide valid, accurate, reliable, and complete personal data information to Populix, then Populix has the right to terminate the User’s access and account.
6. Access to Populix services is permitted for a limited time, and Populix may withdraw or modify the service without prior notice. Populix will not be responsible if – for some reason – the Populix service is unavailable at any time or every period.
7. Populix may restrict registered users’ access to certain parts of the Populix service.
8. User who wishes to use the Populix service must upload an Identity Card (KTP) and be at least 17 (seventeen) years old, according to the date of birth listed on the ID card, to be able to use the Populix service. For User under 17 (seventeen) years old who wants to use Populix services, by registering with Populix, Populix assumes that the Parents or Guardians of the User know and agree to the User’s registration and participation.
Study
1. User will be sent an email and/or notification that contains an invitation to participate in a study or information via the website, application, or directly by Populix.
2. Populix has the right to determine the target participants in a study to certain users according to the study’s criteria.
3. User is only entitled to take studies provided and invited directly by Populix.
4. Studies may be terminated directly by Populix, and Populix reserves the right not to reward User who has completed such studies.
5. Populix reserves the right to disqualify an answer from a User if it does not meet the specifications of a study, and the User will not be rewarded.
6. Populix has the right to disqualify the answer from the User if it is found there are allegations of cheating and/or violations in participating in and/or answering a study provided by Populix.
7. Populix has the right to disqualify answers from User who has participated in and answered a study that is no longer valid or outside the time limit set by Populix.
8. User is not allowed to participate in/repeat the same study without Populix’s consent.
9. All studies that have been run or created through the Populix service will be stored by Populix. Populix reserves the right to analyze the study.
10. User understands that some studies may contain future plans or have economy value research of a brand or company, hence User agree that all the studies they participate in confidential and must not disseminate any questions they obtain from the studies.
Information Data
1. The User agrees that Populix has the right to store and use all information and data provided to Populix or generated from reports made by Populix. Such information and data may be used for analysis and marketing purposes carried out by Populix.
2. The User agrees that Populix can analyze and present User information and data, as well as the results of studies that have been carried out by Populix. The User also agrees that Populix can process such information and data to make reports for parties that work with Populix.
3. Populix guarantees user information and data confidentiality, including name, email, address, mobile number, and information listed on the Identity Card (KTP). Populix will not provide User information and data to parties who cooperate with Populix without the User’s consent, but Populix will identify Users anonymously to parties working with Populix.
4. The Populix service allows Users to load sites or references to information, content, and services that third parties have provided. Populix is not responsible for User information and data sent and stored by third parties.
Balance and Withdrawals
1. User will be given a balance in the form of Rewards if the User participates in the Populix study and Populix has approved the answer.
2. balance is only given to Users who have an account on the Populix service.
3. Populix has the right to reduce the User’s balance if fraud, duplication, and inaccuracies are found in the study that the User participates in.
4. Withdrawals between banks will be processed within a maximum of 3 x 24 hours working days.
5. If an alleged violation of the Populix Terms and Conditions, fraud, and crime is found, Populix has the right to postpone and/or cancel the withdrawal of funds made by the User.
PopMart Points and Exchange
1. The User will earn point as a reward if the User participates in Populix’s in-app’s activities such as Popcheck, weekly study, and other activities that are held by Populix.
2. The points can be used to exchange items available at PopMart.
3. All items available at PopMart are not sponsored by or consignment of another party.
4. Populix has the right to reduce the User’s points if fraud, duplication, and inaccuracies are found in the activity that the User participates in.
5. If an alleged violation of the Populix Terms and Conditions, fraud, and crime is found, Populix has the right to postpone and/or cancel the exchange of points requested by the User.
Super PopStar
1. Minimum age of 17 years old and/or already have an ID card (KTP).
2. Have and register an active social media account on one or all of the following platforms; Instagram, TikTok, Facebook, or X (Twitter).
3. The social media account listed must be a public account or not set to private mode.
4. The social media account listed will not be set to private mode for as long as user remains a Super PopStar.
5. Comply with the terms and conditions applicable to each task or mission participated in.
6. Complete tasks within the specified submission period for each task.
7. Agree to have their Super PopStar status deactivated if any or all of the listed social media accounts are changed to private mode or if user is found to have committed serious violations of the terms and conditions applicable to the missions or tasks user participated in.
Account Deletion
1. The User agrees that Populix has the right to eliminate access to the User’s account if an alleged violation of the Populix Terms and Conditions is found.
2. Populix has the right to eliminate access to the Populix service and/or terminate the account of a User who has an alleged violation of the Populix Terms and Conditions. If the User’s account is deleted by Populix, the User’s balance is considered invalid and cannot be withdrawn or withdrawn by the User.
3. Termination of the User’s account only deletes the personal information data that has been stored in Populix, but the information data provided by the User in a study will not be deleted.
Intellectual Property Rights
1. Populix is the owner or licensee of all intellectual property rights in the Populix websites and applications and the material published on them. These works are protected by copyright laws and treaties worldwide, and all these rights are protected by law. Users may not use any part of the material contained in the Populix services for commercial purposes without obtaining a license from Populix or Populix’s licensors.
2. If the User prints, copies, or downloads part of the Populix service that violates these Terms of Use, the User’s right to use the Populix service will be terminated immediately. The User must destroy the copy of materials that the User has made.
Link from Populix
1. User can link to the Populix website’s homepage, as long as the User does so in a fair and legal manner and does not harm Populix’s reputation or take advantage of it. However, the User must not create a link in such a way as to give the impression of any form of association, approval, or endorsement on Populix’s part while it is not the real case.
2. Populix reserves the right to revoke linking permissions without notice.
3. If the Populix service has links to other sites and resources provided by third parties, those links are solely for User information. Populix has no control over the content of such sites or resources, and is not responsible for them or for any loss or damage that may arise from the User’s use of the links
4. The Populix service is integrated with Facebook, which means that if a User subscribes to a service provided by Meta, Users can use services integrated into Populix services. The User’s use of these services (and the use of the User’s associated personal information) will be governed by the terms and conditions applicable to Meta.
Violations, Suspensions, and Terminations
1. If the User violates these Terms of Use or the Terms of Service, Populix may take the following actions as deemed appropriate in the circumstances:
  - Immediate, temporary, or permanent withdrawal of the User’s right to use the Website and/or Populix services
  - Provide warnings to the User
  - File a lawsuit against the User; or
  - Disclosing User information to the relevant law enforcement officers.
2. User agrees to indemnify Populix against all costs, losses, damages, expenses, and liabilities (including, but not limited to, reasonable administrative and legal fees) suffered, incurred, or paid by us as a result of a breach of the Terms of Use, Terms of Service or Populix Privacy Policy.
Jurisdiction and Applicable Law
1. Jakarta Barat District Court, Indonesia, will have exclusive jurisdiction over any claims arising out of or related to the User’s use of Populix services. However, we have the right to file a claim against the User for violating these Terms & Conditions in the User’s country of residence or any other country where relevant. These Terms & Conditions, and any dispute or claim arising out of or in connection with or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Republic of Indonesia.
2. If a court or authorized official decides that any provision of these Terms & Conditions or Privacy Policy or Cookie Policy is invalid, unlawful, or unenforceable to some extent, that term will, to the extent determined, be removed from the the entirety of the terms, which will remain in effect to the fullest extent permitted by law.
Other Terms
1. User is not allowed to use Populix services by using a false identity or belonging to another person.
2. User is not allowed to use Populix services to carry out illegal activities.
3. User is not allowed to collect and store data and personal information belonging to other Users.
4. User is not allowed to collect and store the results of a study conducted by Populix without Populix’s consent.
5. User is not allowed to use Populix services in any way that violates applicable local, national or international laws or regulations.
6. User is not allowed to abuse Populix services by introducing viruses, Trojans, or other harmful things.
7. User is not allowed to attempt to gain unauthorized access to the Populix services, the servers on which the Populix websites and applications are stored, or the servers, computers, or databases connected to the Populix services.
8. User is not allowed to attack Populix websites and applications via denial-of-service attacks or distributed denial-of-service attacks.
9. User is not allowed to send, or cause delivery, unsolicited or unauthorized advertising or promotional materials or other similar forms of solicitation (spam).
10. Populix is not responsible to the User for any loss or damage resulting from denial-of-service attacks, viruses, or other harmful things that may harm computer equipment, computer programs, data, or other proprietary materials as a result of the use of the Populix services or the downloading of any posted material in it, or in any Populix services associated with it.
