Terms & Conditions Poplite

Thank you for visiting Poplite by Populix (“Platform”). Please read these Terms & Conditions (“Terms & Conditions”) of PT Populix Informasi Teknologi (“We”). This Terms & Conditions govern Your use of Platform. User must read this Terms and Conditions because it affects their rights and obligations under the law. Yang dimaksud dengan Anda atau Pengguna adalah: a. Setiap orang yang membuka dan/atau mengakses Platform; b. Setiap orang yang menggunakan layanan dan/atau fitur yang terdapat pada Platform.

User Statement
1. By ticking “I agree” when using the Platform or creating Survey, the User is deemed to have read, understood, and agreed to all contents in the Terms & Conditions.
2. Terms & Conditions constitute a valid agreement between the User and Us. If the User does not agree to one, part, or all of the contents of the Terms & Conditions, then the User is not allowed to use the services on the Platforms.
3. User who is below 18 (eighteen) years old asserts and warrants that they have obtained approval from their parents or legal guardian to agree to this Terms & Conditions and Privacy Policy.
4. Access to the services on Platform is provided “as is”, and the use of Platform is at the User’s own risk. To the extent permitted by law:
5. We expressly excludes all terms, warranties, and other conditions which may not be statutory;
6. We expressly excludes liability for indirect or consequential loss or damage incurred by the User in connection with Our services or with the use, inability to use, or results of using our services, whatever the cause;
Usage Requirement
1. Account and password confidentiality and activities of an account are the personal responsibility of the owner of the account. We are not responsible for any activities carried out by an account, except for those carried out by Us and directly impact the account owner.
Study
1. User can create a questionnaire by multi-ways;
  1. independently by designing your own questions;
  2. using artificial intelligence (AI) embbed in the Platform to help build survey faster and easier; or
  3. importing a Google Form from your chosen Google account to the Platform.
2. User is advised to review and edit the questions generated from AI to ensure the survey’s applicability and relevance with User’s study. The risk incurred from User’s decision to use the questions from AI without editing will be the User’s sole responsibilities.
3. Survey can be distributed to Populix respondents or via link that We create for you to be distributed to your own respondents.
4. If survey is going to be distributed to our respondents, User is prohibited from asking a question within the survey asking for respondents’ identfiable personal data. User must respect and adhere to the personal data protection and privacy of the respondents as set out in https://info.populix.co/articles/en/privacy-policy/.
5. If survey will be distributed to Your own respondent, question of respondents’ identifiable personal data must not be mandatory and you must respect and adhere to the personal data protection and privacy that is applicable in the territory or of Your respondents.
Balance and Payment
1. To launch a survey to our respondents, a User must pay survey fee. The survey fee can be paid within 2 ways:
  1. top-up of balance named PopCoins. PopCoin’s value is 1 popcoin = IDR 1.
  2. Payment via transfer bank, credit or debit card, e-wallet, or QRIS.
2. Balance cannot be withdrawn to cash.
3. We reserve the right to change the price of survey fee, with notice to you. Price changes will affect existing and new surveys that have not been launched yet.
Account Deletion
1. You can request to delete your account by sending us a written request. We will need sufficient information from you to confirm your identity and the nature of your request for us to handle your request. Therefore, please submit your request in writing by sending us an e-mail at account-manager@populix.co or use the “Contact Us” form from https://info.populix.co/contact-us.
2. The User agrees that We have the right to eliminate User’s account access if alleged violation of the Terms and Condition is found. If the User’s account is deleted by us, the User’s balance is considered invalid and cannot be withdrawn or withdrawn by the User.
3. Deletion or elimination of the User’s account only deletes the personal information data that has been stored in Us, but the survey data and result will not be deleted.
Intellectual Property Rights
1. We are the owner or licensee of all intellectual property rights in the Platforms and services and the material published on them. These works are protected by copyright laws and treaties worldwide, and all these rights are protected by law. Users may not use any part of the material contained in the Platform for commercial purposes without obtaining a license from Us or Our’ licensors.
Third-Party Services
1. Third-Party Links: The Platform may contain links to third-party websites or services that are not owned or controlled by Us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You are independently responsible to read and review the third party’s policies and terms.
2. Third-Party Integrations: The Platform may integrate with third-party services to enhance functionality and provide better user experience for You . Your use of these third-party services is subject to their respective terms and conditions.
Link of the Platform
1. User can copy Platform’s link and add the link to social media, as long as the User does so in a fair and legal manner and does not harm Our reputation or take advantage of it. However, User must not add the link in such a way as to give the impression of any form of association, approval, or endorsement on our part while it is not the real case.
2. We reserve the right to require You taking down the link or revoke linking permissions without notice.
3. If Platform has links to other sites and resources provided by third parties, those links are solely for User information. We have no control over the content of such sites or resources, and is not responsible for them or for any loss or damage that may arise from the User’s use of the links.
Prohibited Misconduct
1. User is not allowed to use the Platform by using a false identity or belonging to another person.
2. User is not allowed to use the Platform to carry out illegal activities.
3. User is not allowed to collect and store data and personal information belonging to other Users.
4. User is not allowed to use Platform in any way that violates applicable local, national or international laws or regulations.
5. User is not allowed to abuse Platform by introducing viruses, Trojans, or other harmful things.
6. User is not allowed to attempt to gain unauthorized access to the Platform, the servers on which the Websit is stored, or the servers, computers, or databases connected to the Platform.
7. User is not allowed to attack our Platform via denial-of-service attacks or distributed denial-of-service attacks.
8. User is not allowed to send, or cause delivery, unsolicited or unauthorized advertising or promotional materials or other similar forms of solicitation (spam).
9. Unless approved by the Platform in writing, User is not allowed to create a question about a respondent’s identifiable personal data.
10. We are not responsible to the User for any loss or damage resulting from denial-of-service attacks, viruses, or other harmful things that may harm computer equipment, computer programs, data, or other proprietary materials as a result of the use of the Platforms or the downloading of any posted material in it, or in any Platform’s services associated with it.
Violations, Suspensions, and Terminations
1. If the User violates these Terms & Conditions, We may take the following actions as deemed appropriate in the circumstances:
  1. Immediate, temporary, or permanent termination of the User’s use and access the Platform;
  2. Provide warnings to the User; and/or
  3. undertake any other measures that are permitted by the laws and regulations;
2. The User agrees to indemnify us against all costs, losses, damages, expenses, and liabilities suffered, incurred, or paid by us as a result of a breach of these Terms & Conditions and Privacy Policy
Amendment
1. Amendments: We may amend these Terms and Conditions at any time by posting the updated Terms on the Platform. The changes will be effective immediately upon posting. Your continued use of the Platform after the posting of the updated Terms constitutes your acceptance of the changes.
2. Notice of Changes: If we make material changes to these Terms, we will provide you with notice by email or by posting a notice on the Platform.
Jurisdiction and Applicable Law
1. This Terms and Conditions and any claims arising out of or in connection with the Term and its subject matter will be governed by and construed under the laws of the Republic of Indonesia, without reference to its conflicts of law principles. The parties submit to the exclusive jurisdiction of the Jakarta Barat District Court located in Jakarta Barat, Indonesia. Each party waives any objections to the jurisdictions identified in this provision.
2. If the court identified in 10.1 decides that any provision of these Terms and Conditions and Privacy Policy is invalid, unlawful, or unenforceable to some extent, that provision will, to the extent determined, be removed from the the entirety of the Terms, which will remain in effect to the fullest extent permitted by law.
